Legal Update: Dealing with Complaints - The Complainant

A strata council receives complaints about bylaw contraventions and has a duty to enforce the bylaws. The Strata Property Act sets out the procedure for enforcement, but is silent on how to deal with the complainant. While complaints about single bylaw contraventions can usually be addressed easily, the situation is different when the complainant is impacted by a repeated or continued contravention that impacts the use and enjoyment of their strata lot. This seminar addresses the complainant issues, and provides suggestions on managing the complainant with a view to avoiding a CRT claim started by the complainant for failure to enforce the bylaws.
