The CRT’s second decision ever was an order imposing a $100,000.00 special levy for foundation repairs in a small 4-Plex. Although the CRT went on to make similar orders over the next few years, the CRT seems to have changed its position. Today, it seems that the CRT will order a strata corporation to undertake needed repairs, but it will not necessarily order a strata corporation to pay for them.
This presentation will review a strata’s options for getting repairs done when owners refuse to fund them. Although our focus will be on using the CRT for these orders, we will also touch upon the other options available to the Strata Corporation under the Strata Property Act. The main decision reviewed during the presentation will be Wong’s Management (1990) Enterprises Ltd. v. The Owners, Strata Plan LMS 3259
